One of the most common questions people ask when navigating Canadian immigration is whether they should hire an immigration lawyer or an immigration consultant. Both can help you prepare and submit applications to IRCC. But there are meaningful differences in training, scope of authority, and what each can do for you when things become complicated.

Who Is Authorized to Provide Immigration Advice in Canada?

In Canada, only two categories of professionals are legally permitted to give immigration advice for compensation:

  • Lawyers and Quebec notaries who are members of a provincial or territorial law society
  • Regulated Canadian Immigration Consultants (RCICs) who are members of the College of Immigration and Citizenship Consultants (CICC)

Anyone else who charges fees to help with an immigration application is operating illegally. Ghost consultants and unregulated advisors have cost thousands of applicants their cases and their money. Always verify credentials before hiring anyone.

What Can an Immigration Consultant Do?

  • Assess your eligibility for various immigration programs
  • Help you compile documents and complete application forms
  • Submit applications to IRCC on your behalf
  • Represent you in proceedings before IRCC and the IRB in certain matters
  • Advise you on immigration strategy and options

What Can an Immigration Lawyer Do?

An immigration lawyer can do everything an RCIC can do, and more:

  • Advise you on how immigration intersects with criminal law, family law, and employment law
  • Represent you in Federal Court for judicial review of refused applications
  • Represent you at all levels of the Immigration Appeal Division (IAD)
  • Handle complex inadmissibility cases, including criminal inadmissibility and misrepresentation allegations
  • Advise on immigration consequences of criminal charges

When Does It Matter Which One You Choose?

For a straightforward application with a clean background and solid documentation, an experienced RCIC is often fully capable. Consider hiring an immigration lawyer if:

  • Your application has been refused and you want to appeal or apply for judicial review
  • You have a criminal record or have been charged with an offence
  • You have a previous deportation order or removal from Canada
  • Your application involves allegations of misrepresentation
  • You need advice on how immigration interacts with your business, estate, or family situation
  • Your case involves an admissibility hearing at the IRB

Frequently Asked Questions

Is an immigration consultant cheaper than a lawyer? Often, but not always. Consultants may charge lower fees for routine applications. However, if your case requires judicial review or legal proceedings, a lawyer is the only option.

Can I switch from a consultant to a lawyer mid-application? Yes. You can change your authorized representative at any stage. If your situation has become more complex, moving to a lawyer is often advisable.

What if I was scammed by an unauthorized representative? Report the person to your provincial regulator and to IRCC directly. A lawyer can advise you on how to address the damage to your application.
