Work Permit Extension in Canada: What You Need to Know
If your Canadian work permit is expiring, you must apply for an extension before it runs out. Here is how the process works, how to maintain your status, and what to do if your permit has already expired.
A Canadian work permit does not renew itself. If you want to continue working in Canada after your permit expires, you must apply for an extension before the expiry date. Failing to do this on time can affect your immigration status and your ability to remain in Canada legally.
Who Can Apply to Extend a Work Permit?
- You are currently in Canada
- Your permit has not yet expired
- You continue to meet the conditions of your work permit category
You cannot extend a work permit from outside Canada. If you have already left or your permit has expired and you have also left the country, you will need to apply for a new work permit rather than an extension.
Types of Work Permits: Employer-Specific vs. Open
Employer-specific work permits tie you to a single employer, occupation, and location. If any of these change, you need a new permit, not just an extension. To extend this type of permit, your employer typically needs to renew their LMIA or confirm their continued need for your services.
Open work permits allow you to work for any employer in Canada without being tied to a specific job. Common categories include Post-Graduation Work Permits (PGWP), open work permits for spouses of skilled workers or students, and Bridging Open Work Permits (BOWP).
How to Apply for a Work Permit Extension
Step 1: Check your eligibility and gather documents. Confirm your current permit category, review the extension requirements, and collect supporting documents including your current permit, passport, and employment letter.
Step 2: Submit before your permit expires. Apply as early as 90 days before your permit's expiry date. Online applications through your IRCC account are processed faster than paper applications.
Step 3: Confirm your application was received. Keep your application number and the confirmation email. You can track your application status through your IRCC account.
Maintained Status: What It Means and Why It Matters
If you applied to extend your work permit before it expired but have not received a decision yet, you are protected by maintained status (sometimes referred to as implied status). This allows you to continue living and working in Canada under the same conditions as your current permit while your extension application is pending. This is automatic.
- Maintained status ends when you receive a decision on your extension application (approved or refused)
- Maintained status ends when you leave Canada
- Maintained status ends when you withdraw your application
Bridging Open Work Permit: A Key Option
If you have applied for permanent residency under Express Entry or a Provincial Nominee Program and your work permit is expiring while you wait for a decision, you may be eligible for a Bridging Open Work Permit (BOWP). The BOWP allows you to continue working without being tied to a specific employer. To qualify, your PR application must be in process and your current permit must be expiring within four months.
What If Your Work Permit Has Already Expired?
If your permit has expired and you did not apply for an extension before it ran out, your legal status to work has lapsed. You must stop working immediately. You may be able to restore your status if you apply within 90 days of the expiry date, but this is not guaranteed. If 90 days have passed, you would need to leave Canada and apply for a new permit from outside the country.
Frequently Asked Questions
Can I travel outside Canada while my extension is pending? You can travel, but maintained status ends the moment you leave Canada. Only travel if you have an approved new permit or understand the risk.
My employer says I do not need to do anything. Is that correct? No. Work permit extensions are your responsibility, not your employer's. Your employer does not manage your immigration status.
Can I apply to extend a work permit if my passport expires soon? IRCC will not issue a work permit valid beyond your passport's expiry date. Renew your passport before applying if it expires in the near future.
Does a work permit extension affect my PR application? No. Extending your work permit while a PR application is pending is normal and expected.
